Public School Responsibilities to Students with Disabilities: Participation in Nonacademic and Extracurricular Activities

The United States Department of Education, Office for Civil Rights (OCR), issued a letter on January 25, 2013, to clarify a public school's responsibilities related to extracurricular activities for students with disabilities. Under Section 504 of the Rehabilitation Act of 1973, students with disabilities must be provided opportunities, equal to those provided to nondisabled students, in terms of participation in nonacademic and extracurricular activities. While these requirements are not new, the OCR letter reviewed a school district's legal obligations and provided specific examples of discriminatory practices to help guide decision-making by teachers, coaches and administrators when a disabled student wishes to participate in nonacademic and extracurricular activities.
